PFD operates its website subject to the following Terms of Use (“Terms”), and reserves the right, at its sole discretion, to change or modify these Terms from time to time without further notice to you by posting new Terms on the PFD website at http://www.photoframed.com (the “Site”).

1. Age Requirements: The Site is not intended for use by children under the age of 13 years. Use by persons under the age of 18 years, but at least 13 years, is permitted under the supervision of a parent or guardian who agrees to be bound by these Terms.
2. Account and Password Creation: By creating a user account, you agree to provide PFD with a current email address that is not false, designed to impersonate another person, or otherwise misleading as to the origin of any written or uploaded content. You will be required to create a password, and you are responsible for maintaining its confidentiality.
3. Account Use and Security: You are responsible for all activity that occurs under your account and password. If you suspect a breach of security, such as an unauthorized use of your password or account, you agree to immediately notify PFD of same. Furthermore, you agree to exit your account at the end of every session on the Site. PFD will not be held liable for any loss or damage arising from your failure to comply with this Section 3.
4. User Submissions: You may submit certain materials to PFD, including without limitation, digital photographic images (“Content”), as part of your use of the Site. You agree that you will NOT upload, post, email or otherwise transmit any of the following Content:
a. Any unlawful, defamatory, threatening, vulgar, indecent, obscene, libelous or inappropriate material.

b. Any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights.
c. Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the intended functioning of any computer software or hardware.

Upon submitting Content, you authorize PFD to review it for adherence to PFD’s guidelines and compliance with the Terms. PFD and its designees shall have the right to remove any Content that violates the Terms or is otherwise objectionable to PFD, and to refuse to produce any product incorporating such Content. The production by PFD of any product incorporating your Content does not mean that PFD approves of the Content, that the Content obeys all applicable laws, or that you no longer have any responsibility for the use of the Content.

 

You acknowledge and agree that PFD may store Content and may also disclose Content if required to do so by law or in the good faith belief that such storage or disclosure is reasonably necessary to enforce the Terms.
5. User Conduct: In using the Site, you agree to not:
a. Upload, download, post, email or otherwise transmit false or misleading information;
b. Disrupt or interfere with the security of the Site, or any services, system resources, accounts, servers, or networks connected to or accessible through the Site or any affiliated or linked websites.

c. Access, tamper with, or use any non-public areas of the Site. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution in the applicable legal jurisdiction.
d. Disrupt or interfere with any other user’s enjoyment of the Site or any affiliated or linked websites.
e. Frame or link to the Site except as permitted in writing by PFD.
6. Pricing and Shipping: Prices for products and services offered on the Site are described therein and incorporated into these Terms by reference. All prices are in U.S. Dollars. Prices and products may change at the discretion of PFD. All items purchased through the Site are made pursuant to a shipping contract. Once PFD has transferred the items to the shipping carrier, all title and risk of loss for products ordered by you shall pass to you.
7. Privacy Policy: PFD respects your privacy. Users of the Site should refer to PFD’s Privacy Policy which sets forth how personal information is collected and used. By opening an account on the Site, you expressly consent to PFD’s disclosure and use of your personal information (including using email to communicate with you) as described in the Privacy Policy, which is incorporated into the Terms by reference.
